This agreement applies between you, the User of this Website and MindSpace Coaching, the owner of this Website. 10. Accounts
10.1 In order to purchase Goods on this Website and to use the Forums facilities you are required to create an Account which will contain certain personal details and payment Information. This may vary based upon your use of the Website as we may not require payment information until you wish to make a purchase.
By continuing to use this Website you represent and warrant that:
10.1.1 all information you submit is accurate and truthful;
10.1.2 you have permission to submit Payment Information where permission may be required; and
10.1.3 you will keep this information accurate and up-to-date.
Your creation of an Account is further affirmation of your representation and warranty.
10.2 It is recommended that you do not share your Account details, particularly your username and password. MindSpace Coaching accepts no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
10.3 If you have reason to believe that your Account details have been obtained by another without consent, you should contact MindSpace Coaching immediately to suspend your Account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled until they are delivered. In the event that an unauthorised purchase is delivered prior to your notifying us of the unauthorised nature of the purchase, MindSpace Coaching accepts no liability or responsibility.
10.4 When choosing your user name you are required to adhere to the terms set out above in Clause 8. Any failure to do so could result in the suspension and/or deletion of your Account.
11. Termination and Cancellation
11.1 Either MindSpace Coaching or you may terminate your Account. If MindSpace Coaching terminates your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.
11.2 Business FastTrack, Business Academy & other specified programs: For 100% Money Back Guarantee clients are asked to provide evidence of completing the lessons and associated study documents within 24 hours of their refund request. Refunds will only be processed once sufficient proof of completion & action has been provided within 24 hours of the request.
11.3 All Coaching Programs must be commenced within 6 months of purchase.
12. Goods, Pricing and Availability
12.1 Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from MindSpace Coaching correspond to the actual Goods, MindSpace Coaching is not responsible for any variations from these descriptions.
12.2 All pricing information on the Website is correct at the time of going online. MindSpace Coaching reserves the right to change prices and alter or remove any special offers from time to time and as necessary. All pricing information is reviewed and updated every month.
12.3 In the event that prices are changed during the period between an order being placed and MindSpace Coaching processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price;
12.4 All prices on the Website include VAT unless explicitly stated. MindSpace Coaching is registered for VAT
13. Delivery
13.1 MindSpace Coaching will notify you by email when your goods are to be delivered to you. The message will contain access details.
13.2 If MindSpace Coaching receives no communication from you, within 7 days of delivery, you are deemed to have received the Goods in full working order and with no problems.
14. Cooling off Period
14.1 You have a statutory right to a “cooling off” period. This period begins once your order is complete and ends 7 days after the Goods have been delivered. If you change your mind about the goods within this period, please notify MindSpace Coaching within 7 days of receipt.
14.2 Paid tickets for MindSpace Coaching events are refundable within 7 days of purchase. After this period, tickets are non-refundable but transferable once (upon payment of an administration fee – currently £25) by contacting us at [email protected]
14.3 MindSpace Coaching also promotes events for other speakers. Policies set forth by these partners may prohibit us from issuing any refunds even within the initial 7 day period.
14.4 If you wish to cancel your purchase for any of the above reasons, please contact us at [email protected] to make the appropriate arrangements.
14.5 MindSpace Coaching reserves the right to exercise discretion with respect to any refund under these Terms and Conditions. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:
14.5.1 Any use or enjoyment that you may have already had out of the Goods;
14.5.2 The fact that the Goods consist of audio or video recordings or computer software and the recordings have been opened;
14.5.3 Any discounts that may have formed part of the purchase price of the Goods at the time of purchase.
Such discretion to be exercised only within the confines of the law.
16. Complaints Policy
16.1 MindSpace Coaching is committed to the highest standards of customer care. Our team follow MindSpace Coaching’s Code of Honour and will do all that they can to resolve any issues that may arise quickly and fairly.
16.1.2 In addition, as an accredited member of the International Association for Professional Coaching & Mentoring (IAPC and M), MindSpace Coaching is committed to having a positive attitude to complaints. Any complaint is listened to and taken seriously since we recognise that it contributes to the improvement of the service we provide.
16.2 Making a Complaint
16.2.1 If you are unhappy with our service please let us know as soon as possible by emailing [email protected] If you are not happy with our response and wish to raise a complaint, you should raise it within six months of the event which has given rise to the complaint or within six months of becoming aware that there was cause for complaint.

16.2.5. In the first instance, your complaint must be registered with us as your service provider, so please contact [email protected] Complaints follow three stages:
16.3 Stage 1 (Informal Stage)
16.3.1 MindSpace Coaching aims to be able to deal with the majority of concerns or complaints informally within 48 hours of receipt.
16.3.2 If you feel that your complaint has not been resolved through the informal stage, or warrants a formal investigation, you will need to make a formal complaint.
16.4. Stage 2 (Making a Formal Complaint)
16.4.1 A formal complaint must be made in writing and be clearly identified as a formal complaint.

16.4.3 Once a complaint is received, an acknowledgement will be sent within 7 days. We will carry out an investigation, or, where appropriate, appoint someone else to do so. The outcome of the investigation will be sent to you in writing within 21 days.
16.5 Stage 3 (International Association for Professional Coaching and Mentoring)
16.5.1 If the outcome of a formal investigation by MindSpace Coaching is not satisfactory, you can escalate your complaint to the International Association for Professional Coaching and Mentoring via email to [email protected]
17. Confidentiality
17.1. All complaints received will be treated in confidence and only shared with the International Association for Professional Coaching & Mentoring in the event of the complaint being escalated to them.
18. Privacy

The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
MindSpace Coaching accepts no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
22. Limitation of Liability
22.1 To the maximum extent permitted by law, MindSpace Coaching accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. Users should be aware that they use the Website and its Content at their own risk.
22.2 Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

26. Law and Jurisdiction
These terms and conditions and the relationship between you and MindSpace Coaching shall be governed by and construed in accordance with the Law of England and Wales.
